This Disclaimer and Limitation of Liability Policy (“Policy”) governs the use of the Connect+ platform, services, mobile-accessible cards, NFC-enabled tools, and all associated web properties operated under Digit Etcetera (Bangladesh) and Fusion Digi (Canada) (collectively referred to as “Connect+”, “we”, “us”, or “our”).

By using our services, you (“User”, “Customer”, “Partner”, or “Visitor”) acknowledge and agree to the terms stated in this document.

1. General Disclaimer

a. Informational Nature

All content, tools, and services provided by Connect+ are intended for informational and commercial presentation purposes only. While we aim to provide accurate, updated, and relevant services, we do not guarantee the completeness, accuracy, or suitability of any information, content, or results.

b. Third-Party Services and Content

Connect+ integrates and utilizes third-party platforms, APIs, plugins, and services (e.g., CRM tools, appointment systems, payment gateways, design platforms). We do not control or warrant the performance, reliability, or policies of third-party tools. Use of these services is subject to their respective terms.

We are not liable for:

- Disruption in services due to third-party outages
- Feature depreciation or withdrawal of external platforms
- Data loss or breach originating from third-party components

2. No Professional Advice

Connect+ does not provide legal, financial, marketing, or business consulting advice. Any templates, suggestions, or tools made available through the platform are offered “as-is” and must not be construed as professional guidance.

You are solely responsible for verifying, validating, and applying any suggestions, templates, or automations in your business or legal context.

3. Limitation of Liability

To the fullest extent permitted by applicable law, Connect+ and its owners, affiliates, developers, agents, employees, licensors, and contractors shall not be held liable for:

- Any direct, indirect, incidental, consequential, or punitive damages resulting from:

- Use or inability to use the service
- Errors, delays, or interruptions in service
- Unauthorized access or alterations to user transmissions or data
- Loss of business, revenue, data, or goodwill
- Actions taken by third-party service providers or partner accounts

- Damages exceeding the amount you have paid for the service over the preceding three (3) months.

4. Service Availability and Modifications

Connect+ does not guarantee uninterrupted access, error-free performance, or availability of features at all times. We reserve the right to:

- Modify, suspend, or discontinue any part of our service or platform at any time with or without prior notice.
- Implement updates, patches, or limitations to ensure system integrity or compliance with policy.

5. User Responsibility

As a User of Connect+, you agree that:

- You are solely responsible for the content you upload, publish, and share via your vCard or digital page.
- You will not use our services for any illegal, abusive, defamatory, or prohibited purposes.
- You understand that Connect+ acts as a platform provider and not the author, editor, or approver of your published content.

We reserve the right to suspend or terminate services to any user found violating applicable laws, our platform terms, or this disclaimer.

6. Affiliate and Partner Disclaimers

Third-party partners, agencies, or PRO service providers who offer services under the Connect+ brand or via co-branded platforms are independent service providers. Connect+ is not responsible for:

- Misrepresentation or negligence by such parties
- Support failures or delivery issues by unofficial partners
- Unauthorized commitments made by third parties claiming association

Users are advised to verify credentials and review the terms of such services separately before engaging with any partner or reseller.

7. Indemnification

You agree to indemnify, defend, and hold harmless Connect+, its affiliates, directors, officers, employees, licensors, and contractors from any claim, liability, damages, loss, or expenses (including legal fees) arising out of:

- Your misuse of the services
- Your breach of any term or policy
- Your violation of any third-party rights
- Your failure to comply with applicable law

8. Governing Law and Jurisdiction

This disclaimer is governed by and construed in accordance with the laws of:

- Bangladesh for users served under Digit Etcetera
- Canada for users served under Fusion Digi

Disputes arising from this disclaimer shall be resolved through arbitration or court proceedings in the appropriate jurisdiction as per our Terms of Service.
